The most Important Job a Realtor Has
A Realtor wears many hats, and is expected to help their
Clients get through a transaction with little or no problems. Anyone who has
been in this business for a any period of time knows how difficult it is to keep
your client happy, but also do what is right for their client, but also the
industry.
One of the most important jobs a Realtor has is to keep
their client out of court and believe me, it is not always an easy task. I have been asked so many strange things by
clients that I have had to decline and risk losing business, because what they
were asking was wrong. I even had to go to court against my client after a
transaction, because I followed the contract in order to keep my client out of court.
What happened was we were at the end of the transaction and
the deal closed, prior to doing the termite work which included tenting the
property. The cost was around $4000.00. I ordered the termite work and my
client understood that it was in the contract and that I had ordered it to be
done. After the work was done, my client refused to pay the termite company,
due to the fact, he said that the new owners closed before the termite work was
done, he felt that they agreed, by closing that the termite work was there
responsibility. I was summoned to court by the termite company, and I told the
judge that my job was to execute the contract and also to keep my client out of
court, and I did have the authority to order the work to be done. I was
actually testifying against my client which I also told the judge that I was
uncomfortable with. In the end, my client
was ordered to pay for the work that was done. I was right to order the work.
If I had to do it over again, I would have had my client order the work since the
transaction has closed already. My client knew he was wrong; he just wanted to
see if he could save $4000.00. But I felt it was my job to do everything that
was legal.
In my business of Property Management in Anaheim Ca. I
stress the disclosures and I want my clients to understand that if they keep
anything out of the disclosures, then they have a real good chance of ending up
in court. My words to them are “Disclose, Disclose and disclose some more. It
is better to get it out right from the beginning then to deal with it after the
fact; I have never had a deal be lost due to disclosures, although it sometimes
does produce some uncomfortable conversations.
The most important thing for a
home owner is be up front, because things will be found out at some point, so
you might as well get it out now.
I really believe that a Realtor needs not only to protect
their clients, but also themselves. The Realtor will always get dragged into
court, even if there is no fault on their part, so Realtors be advised, you
also need to disclose.
