Don’t forget
to write
The other
day, a Tenant called me and was distressed because they need to move by the
end of the month and the new place they thought they had fell through. The
Tenant wanted to know if there was anything they could do about the Landlord
telling them that they had the place and then calling them the next day and
saying he changed his mind.
Unfortunately
My Tenant had nothing in writing and that was a problem.
The Landlord was not a
very good person, but since nothing was in writing the Tenant was out of luck.
I guess If they wanted to take it to court and say they had a verbal agreement,
they could try, but by the time it got to court and even if they won which is
very unlikely, they would have found another place anyway so really, In that
situation it is better to let it go and find a new place.
The real
lessen to the story is, “Don’t Forget to Write” Before you think you have
anything in stone, get it on paper. That way everyone understands what the
rules are and there are no surprises. In the situation we talked about, the
landlord probably received a better offer and he felt he had the right to go
back on his word since there was no contract. Again, I would never do that,
what I do is tell the potential Tenant that if they can get me the deposit by
the next day, the place is there’s. If I don’t get the deposit the next day,
then I will not guarantee the place for them, but they understand the rules.
In my business of Property Management Anaheim Ca. Tenants need to protect themselves from being taken
advantage of, it can be very costly to run multiple credit checks and some
Landlords will use them as leverage with other potential Tenants. So make sure
as a Tenant you do everything you can to lock down the property as soon as you
can and make sure before you pay for a credit check that the Landlord is going
to give you a fair shot at renting the property. Give as much information up
front and you should have a copy of your credit report so even though they will
probably want to run their own, they can see the one you show them and tell you
before you spend any money whether it is good enough for them to rent you the
property.
Do the work before you start looking and get all your information
ready for the potential Landlord and have your deposit ready. If you do all
your work up front, you will save yourself money and frustration.
