Selling a
Tenant occupied Property
Anyone who has ever sold a home understands how
difficult it can be. The ups and downs and all the problems that can arise in a
30 – 45 day Escrow are many. Selling Tenant
occupied properties can have their own problems. All of us in the Real Estate business understand
that in order to sell a property, you need a property to be available for
showings and A Tenant in the property can make showing difficult at best.
Notice of Sale and Entry
For those of us who use the forms from the “California
Association of Realtors”, when we notify a Tenant that the property is going to
be sold, we use the “NSE” (Notice of Sale and Entry) form. It notifies the
Tenant that the property is being sold and with 24 hour verbal notice, the
property can be entered by the Landlord and their Agent to be shown to
potential purchasers. This is actually agreed to by the Tenant in the
Residential Lease agreement.
Notice has been given, Easy to show?
Now that you have given notice and the Tenant
is required with 24 hour notice to allow the property to be shown, all is good.
Not so fast. Even though a Tenant may be required to allow a property to be
shown, they can still make if difficult. First, they may change the locks so
the Tenant has to be there for you to show the property. They may leave the
property messy so it shows poorly. They may say that there is a sickness in the
family, so showings will not be allowed. If this happens, it can be very difficult
to show the property and as Realtors, we know that if it is difficult to show a
property, we will move on to properties that are much easier to show.
Way’s to
make selling the occupied Property easier
There are ways to make selling a property
easier. First, wait until the Tenants move out, but that may not be possible so
we have to be a little creative. The thing that we always have to keep in mind
when trying to show a rental property that is occupied is that the people who
live there are paying rent and they are not going to be very happy, having
people barge through their personal property. What I try and do is limit the
amount of showing to 1 day a week. I know that it is not the most convenient way
of showing a property, but if you give other Realtors a time and day, they will
be more apt to show the property. The next way to get Tenants to cooperate, is
give them a rent rebate. Now I know that you hate to give up some money, but it
may be worth it, especially if you are able to sell the property sooner because
showing will be more convenient. Another thing I do is tell the Tenants that I
will be there with every showing. That may be more work, but it gives the
Tenants a little piece of mind, since they at least know who I am and I will
assure them that their personal property will be respected. Respect is key,
always treat the Tenants as if they are in control. Never try and force
anything. Make sure you make it as non intrusive as possible.
It’s never going to be perfect or easy, but if
you handle it with care, you can make it work and have a successful outcome.
